Con la sentenza 141/2019 la Corte costituzionale ha dichiarato non fondata la questione di legittimità costituzionale dei reati di “reclutamento” e di “favoreggiamento” della prostituzione, proposta dalla Corte d’Appello di Bari. A partire dalla vicenda oggetto di giudizio, e dopo una preliminare indagine sui modelli di regolamentazione normativa della prostituzione volontaria e sui dubbi di legittimità costituzionale espressi dalla ordinanza di remissione, ci si sofferma su taluni aspetti critici della decisione. El presente artículo es el resultado de una investigación realizada a partir del análisis de contenido del medio de comunicación escrito Las Provincias, con el objetivo de conocer y analizar la imagen social que transmiten los medios de comunicación escritos sobre la prostitución de Valencia. The Italian Constitutional Court (141/2019) rejected the issue on the constitutional legitimacy of the crimes of "recruitment" and "aiding and abetting" prostitution, as proposed by the Court of Appeal of Bari. Nevertheless, the causal links between the behavior of facilitating prostitution and the dangers to freedom, security and dignity of the prostitutes are questionable.

Although masculinity is a powerful concept in both sociology and gender studies, previous research forgot to analyse sex work under this perspective. Even though the actors involved are men, and previous studies have highlighted the importance of masculinity not only in the relation man-to-woman but also in the “gay world”, there is a lack of attention in male sex working.
